AI regulation: A pro-innovation approach – EU vs UK


The field of Artificial Intelligence (AI) holds immense potential for transforming various aspects of society, including medical advancements, climate change mitigation, and economic growth. One example of AI’s capabilities is DeepMind’s technology that can predict the structure of almost every known protein, which has significant implications for medical research.

To capitalize on the opportunities presented by AI, governments are considering regulatory frameworks to create an environment that fosters innovation while ensuring safety and public trust. The UK and EU are both aiming to lead the international conversation on AI governance, and their policy objectives include driving growth, ensuring safety, and facilitating investment and innovation.

Both the UK and EU recognize the importance of protecting end-users from safety risks, violations of fundamental rights, and market failures related to AI systems. However, there are some differences in their policy options. The EU AI Act opts for a single binding horizontal act on AI, while the UK Approach considers delegate existing regulators with a duty to regard AI governance principles, supported by a central AI regulator.

Costs of compliance for businesses implementing AI systems are estimated to vary between the UK and EU frameworks, with the UK estimating higher costs for high-risk AI systems. The UK Approach also emphasizes the use of AI assurance techniques and technical standards to ensure compliance and build trust in AI systems.

Both the UK and EU could benefit from developing a harmonized vocabulary with shared definitions of key AI terms to promote a common understanding and collaboration in the field.

Overall, both the UK and EU are focused on responsible AI development, but their approaches may differ in certain aspects. As AI continues to evolve, regulatory efforts will be crucial to harness its potential while safeguarding users and society at large.
